These are our General Terms and Conditions as from 01/04/04

These Terms & Conditions and Privacy Policy constitute an agreement between the Agent, builder or Developer (submitting properties to our database), the
partner or selling agent (a partner or selling agent that links to the Property Portal), and The Property Portal (UK) Ltd and set out the conditions upon which you may use the information and services provided by The Property Portal (UK) Ltd.

The Property Portal is owned and operated by The Property Portal (UK) Ltd, which is a company based in the UK with also office's in Spain and operates under both English and Spainish Law all parties submit themselves to the final direction of the courts in both countries.

The Property Portal (UK) Ltd does not itself represent, directly or indirectly, any of the agents, or other property organisations listed on this website and does not endorse nor recommend the services or products of any such individual agent, office or firm, nor give any warranty or guarantee
concerning the activities of these agents nor any of the properties offered for sale or to rent through such agents. The websites remain the property of The Property Portal (UK) Ltd.

The terms and conditions and privacy policy of the site shall be governed by and construed in accordance with English and Spanish courts of law. I agree to be legally bound by these terms conditions and privacy policy, which may be modified at our discretion.

Personal information, which is received via the Property Portal, will only be used by us for future communications with you and to make improvements to the site. By submitting your information you give your unconditional consent to the use of that information as set out within these Terms and Conditions and Privacy Policy.

We may use log files to help us understand how visitors use our site which are analysed through our statistics package. Logs provide information which is
not linked to any other information that personally identifies the user.

We follow strict security procedures and take appropriate measures to ensure that your personal information is not damaged, destroyed, or disclosed to a
third party without your permission and to prevent unauthorised access to it. Whilst we take all reasonable precautions to protect the personal data of users of this site, we cannot be responsible for and therefore exclude all liability for loss or misuse of personal data, which is misused by unauthorised persons.

Cancellation

Cancelled accounts will be removed from our website on receipt of written or faxed instruction written on your own stationary from you or your authorised
agent to take such action allowing one month’s notice. In the event of the Partner or agent wanting to terminate the association with The Property Portal (UK) Ltd one month’s notice will be required in the form of a written instruction from you or your company, supplied either by fax or postal service, on company stationary.

In any act of bad faith towards The Property Portal Service Ltd, the partners or sales agents, we reserve the right to make effective immediate termination of your contract or agreement including access to the Property Portal and database. All properties submitted will be deleted without further contact.

Links and Service from the website Content on this site including, but not limited to the design, text, code, files and graphics is protected by copyright, and other intellectual property rights which are owned by or licensed to The Property Portal (UK) Ltd. You may view this site and are welcome to print hard copies of material of it for your use. Other forms of copying whether in electronic, hard copy or other format are strictly prohibited.

We try to ensure that the information on this site is accurate, complete and up-to-date, but hold no guarantee. Reliance on the information contained in this site is entirely at your own risk.

The Property Portal (UK) Ltd and our sales agents, builders and developers prepare all the property details, which include photography, text, maps and floor plans in good faith and used as a general guide, not a statement of fact and all prices are subject to contract. Property details do not constitute or form any part of any offer or contract. Any intending purchasers must satisfy themselves by inspection or otherwise as to the correctness of any statements
made within this site.

The Property Portal (UK) or agents, builders or developers have not tested the systems, fittings or appliances within any listed property and give no warranty that they are in good working order. Floor areas of each property has been calculated automatically. It is an approximate, but consistent measure of size allowing you to make comparisons between different properties.

We try to maintain the site to a high standard, due to the nature of software and the internet, no guarantee is given of uninterrupted or error free access to or running of this site or the transactions conducted through it. We shall not be liable for any failure in processing your details due to software or internet errors or unavailability, or circumstances beyond our reasonable control.

There are no warranties that this site or any software or data available on, downloaded or otherwise obtained from it will be free from defects or viruses,
will be compatible with a user's computer equipment or will be fit for any purpose.

The agents, builders and developers will not upload their contact details with any of the property details, as this will compromise the role of the partner, the partners will have the agents, builders and developers contact details supplied separately.

This site contains links to sites operated by third parties. Such links are provided for convenience only and we have no control over their individual content. We therefore make no warranties or representations as to the accuracy or completeness of any of the information appearing in relation to any linked sites nor as to the suitability or quality of any of their products or services and nor do we accept responsibility for the content and information on the linked sites.

Links to this site may not be included in any other site, or elsewhere, without our prior written consent.

Limitation and Liability

Fistly we disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever and howsoever incurred including any direct, consequential or indirect loss or damage or any loss or damage to goodwill or profits or any anticipated loss of savings incurred by you or loss of data or loss of business opportunity, whether arising in tort, contract, equity or otherwise and arising out of or in relation to or in connection with your access to or use of or inability to use the site.

Nothing in this site shall form a contract or part of a contract other than as expressly provided and other than the terms and conditions and privacy policy of the site. It is the full liability of the Estate Agent, Builder or Developer to ensure that the member in the UK receives the correct commission which can be payable by bank transfer. In the case of resale properties the commission is due within a few working days after the date of completion with the Notary. In the case of the sale of new properties the Commission will be paid in whole or in part, however received by the Estate agent builder or developer, within a few working days but will take a longer period before payment is made depending on the development in question. Other expenses are at the discretion of the Estate Agent, builder or developer and partner.
